Wiyatno Gerald Mursjid
Senior Associate

Gerald is Gateway’s Employment and Immigration specialist. In addition to advising, drafting and reviewing all types of employment-related documents and forms (including employee’s stock option plans) and work pass applications, he has the experience and expertise in advising on complex, cross jurisdictional and strategic legal and regulatory matters. He routinely assists foreign and local company management in reviewing and customising HR policies to minimise legal and reputational exposure, as well as, undertaking due diligence exercise, regulatory audits, union, workplace health and safety, workplace discrimination and workplace investigation advisory work. A team player, Gerald frequently works with foreign counsels to provide multi-jurisdictional employment and immigration legal products.

On the employment contentious front, he has represented both individuals and companies. Furthermore, and acting for companies, he provides strategic communication advice and engages with various regulatory bodies to defend against and resolve any regulatory non-compliance.

Gerald serves a diverse array of clientele, ranging from individuals and foreign employees to leading IT and social media multinational companies with a presence in Singapore. While his clients are mainly from the technology sector, some are from the banking, medical, automobile, energy and construction sectors. Notable clients include well-known NYSE-listed global social media company and a US international law firm well known for her global employment and labour practice.

Further cementing his credibility as an employment and immigration specialist, Gerald has been approached and interviewed by Channel NewsAsia to give expert views regarding gig economy workers and their employment rights, if any, and how the law can be further developed. As part of his service offering, he regularly publishes client employment updates, which are in turn re-published on LexisNexis and Singapore Law Watch.

As an associate in the firm’s dispute resolution practice group, Gerald also does litigation and arbitration work, tapping on the in-depth, broad based and hands-on training that he received both as a Relevant Legal Trainee and a Practice Trainee in the International Arbitration and Construction Practice of Singapore’s largest law firm. Since joining Gateway, he has assisted in a lengthy legal trial in the Singapore High Court concerning IP infringement that started out as a private prosecution against the defendants, involved multiple appeals to the Court of Appeal and culminated with an account of profits assessed in favour of the clients. This case resulted in the first local reported judgement in respect of account of profits in the context of IP infringement. For his other corporate clients, he routinely commenced actions to recover money owed to them. Finally, he is now a member of the Singapore Institute of Arbitrators, having passed its International Entry Course.

Reflecting his adaptability, he was seconded to a major Statutory Board, which deals with info-communications, for 7 months, advising its business units on technology related contractual and procurement matters.
